Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and PT FanHub Kreasi Indonesia ("FanHub", "we", "us") governing access to and use of the FanHub website at fanhub.id, the dashboard at app.fanhub.id, and any related APIs and services (collectively, the "Service").
By creating an account or using the Service, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy.
1. Definitions
- Account — your registered access credentials and associated workspace.
- Customer — the individual or organization that enters into these Terms with FanHub.
- User — an authorized individual who accesses the Service under a Customer's account.
- Customer Data — data uploaded, generated, or submitted to the Service by a Customer or User (e.g. watchlists, notes, exports).
- Music Industry Data — third-party data about artists that FanHub aggregates and serves through the Service.
2. Eligibility and accounts
You must be at least 17 years old (the age of digital consent in Indonesia under UU PDP Article 25) and legally capable of entering into a contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately at security@fanhub.id of any unauthorized access.
3. The Service
FanHub aggregates publicly observable signals about Indonesian and international musical artists and presents them as scores, dashboards, and alerts. The Service is currently in private beta; features, scores, methodology, and pricing may change as the platform matures.
The Service is provided as-is during the beta. We do not guarantee uninterrupted availability, exact accuracy of third-party data, or suitability for any particular commercial decision.
4. License to use the Service
Subject to these Terms, FanHub grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during the term of your subscription (or beta participation).
5. Customer Data
You retain all rights to Customer Data. You grant FanHub a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and process Customer Data solely as necessary to provide the Service to you. You represent that you have the right to submit Customer Data and that doing so does not violate any third-party rights.
6. Music Industry Data
Music Industry Data presented in the Service is sourced from public APIs, public web pages, and licensed providers. Scores and rankings are FanHub's editorial output, computed from publicly observable signals. They are not investment advice, not predictions of future outcomes, and not endorsements of any artist.
Artists or their authorized representatives may request removal from the FanHub roster by emailing roster@fanhub.id with proof of identity or representation.
7. Acceptable use
You agree not to:
- Use the Service to violate any applicable law, including Indonesian ITE law (UU ITE) and UU PDP.
- Reverse-engineer, decompile, or attempt to derive source code, except to the limited extent expressly permitted by Indonesian law.
- Resell, sublicense, or share access to the Service without our prior written consent (per-seat limits apply on paid plans).
- Use the Service to send unsolicited messages, harvest contact information, or harass any individual.
- Probe, scan, or test the vulnerability of the Service without our prior written authorization. Coordinated disclosure of security issues is welcome at security@fanhub.id.
- Use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use of it.
- Use the Service to make automated decisions that produce legal or similarly significant effects on individuals, without independent human review.
8. Fees and payment (paid plans only)
During the private beta, the Service is provided at no charge. When paid plans become available, fees and billing terms will be presented at /pricing and disclosed in your order form.
Fees are exclusive of Indonesian VAT (PPN) and any applicable withholding tax (PPh). Invoices are issued monthly or annually as elected. Failure to pay within 14 days of due date may result in suspension of access.
9. Intellectual property
FanHub and our licensors retain all right, title, and interest in the Service, including all software, scoring methodology, brand assets, and documentation. No rights are granted to you except as expressly stated in these Terms.
10. Confidentiality
Each party agrees to keep the other's confidential information confidential and use it only to perform under these Terms. Information is confidential if marked as such or if a reasonable person would understand it to be confidential. This obligation survives termination for three years.
11. Disclaimers
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR THAT MUSIC INDUSTRY DATA WILL BE ACCURATE OR COMPLETE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY INDONESIAN LAW, IN NO EVENT WILL EITHER PARTY BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OPPORTUNITIES, OR DATA, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Each party's total cumulative liability arising out of or relating to these Terms will not exceed the greater of (a) fees paid by you to FanHub in the 12 months preceding the claim, or (b) IDR 10,000,000 (ten million Rupiah). Nothing in these Terms limits liability that cannot be limited under Indonesian law (including for gross negligence or willful misconduct).
13. Indemnification
You will indemnify and hold harmless FanHub, its affiliates, and their respective officers, directors, employees, and agents from and against any third-party claims arising from (a) your breach of these Terms, (b) your Customer Data, or (c) your use of the Service in violation of applicable law.
14. Term and termination
These Terms remain in effect while you use the Service. Either party may terminate (a) for convenience on 30 days' notice, or (b) immediately on written notice if the other party materially breaches and fails to cure within 14 days.
On termination, your access ends. We will provide a 30-day window for you to export Customer Data, after which it will be deleted (subject to retention obligations described in our Privacy Policy).
15. Changes to the Terms
We may update these Terms from time to time. Material changes will be announced via email and an in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
16. Governing law and disputes
These Terms are governed by the laws of the Republic of Indonesia. Disputes arising out of or relating to these Terms will first be attempted in good faith negotiation. If unresolved within 30 days, disputes will be referred to and finally resolved by arbitration under the rules of the Badan Arbitrase Nasional Indonesia (BANI), seated in Jakarta, conducted in Bahasa Indonesia or English.
17. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and any order form, constitute the entire agreement between the parties with respect to the Service.
- No waiver. Failure to enforce any provision is not a waiver of future enforcement.
- Severability. If a provision is unenforceable, the remaining provisions remain in effect.
- Assignment. You may not assign these Terms without our prior written consent. We may assign in connection with a merger, acquisition, or sale of assets, with notice to you.
- Force majeure. Neither party is liable for delays caused by events outside reasonable control.
